not really though considering that you don't have to physically touch someone to be charged with simple assault, and you can serve 2 years for it. I hate the American legal system.

I'm pretty sure you have to actually touch someone for it to be assault, otherwise it's just harassment. That might vary state-to-state though

Is spitting on someone just harassment?
I feel like I heard somewhere that some place considers spitting on someone if you know you have an infectious disease assault, but I can't recall where.
Plus it might not be true.

You could argue it in court, but you would have to show how it actually caused harm. The important part that the person filing the charges has to demonstrate to the court is that they were harmed, and if they were harmed that it was significant enough to justify the court taking action against the offender

Also, I looked at it a little bit more and it is possible to get charged with assault without touching someone but it's gotta show harm. For example, if you get in a yelling match on a bus with someone, that's not going to be assault because there wasn't any harm. Similarly, if you yell at someone on a bus, like absolutely scream at them while they try to walk away and follow them screaming, and as a result you do some real psychological damage to the person, that would be grounds for an assault charge
